If there is only one spot. There is no way Kwan will replace Cohen. It is USFSA rule that only national champion is guarrented a O team spot. The rest spots were selected by USFSA International Commetty....in a normal years these spots went to top finishers at Nationals, but if there is medical petetions, then the rest spots will be decided by the placement and the fields in following competetions:
The GPF
The last worlds
The 4CC
The Nationals
The Junior worlds
and probably JGPF
So Kwan's 4th finish in 2005 give the ground of a conditional medical 'bye'. Her monitoring test gives the final approval being on the team....the whole process was done by specified rule, which was there long before MK's petetion. No cutting slacks and corner, if anything Her 'bye' process is much more scrutinized by media and publice than any US skaters who had been given 'bye' before her.
US runs a far more law biding society than china (though you can argue there are some more stupid laws as well), there is no easy back doors like in china. If you do something not following the rule or law, anyone can sue you, and media will report you. If they send MK instead of Sasha, USFSA would face a law suit from Sasha and USFSA will lost.
Back in 1994, USFSA can't replace Harding with MK because Harding threaten the law suit against USFSA on the ground she is the US champion she has the spot by USFSA's rule....and at the time the court couldn't prove Harding's direct association with the knee wacking....so it was until after Olympics that Harding's association was proved by the court and she was stripped US title for that year.
